Terms of Service

By using Eternalgram you agree to these Terms. They are written plainly because the memorials you build here deserve to be governed by something you can actually read.
1. Acceptance of these terms
By creating an account, building a memorial, posting a tribute, or otherwise using Eternalgram, you agree to be bound by these Terms of Service, our Privacy Policy, and our Content Policy. If you do not agree, please do not use the service.
2. Who can use Eternalgram
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By signing up you confirm that the information you provide is accurate and that you have authority to post the memorial content you upload.
3. Acceptable use
Eternalgram is a place of remembrance. You agree to use the service only for its intended purpose: building and visiting dignified memorials. You will not use Eternalgram for commercial solicitation, spam, automated scraping, security probing, or anything that disrupts the experience of other families.
4. Memorial ownership & responsibility
When you create a memorial you become its owner. You are responsible for the accuracy of biographical information, the lawfulness of uploaded media, and the moderation of tributes posted to that memorial. You retain ownership of the content you upload; you grant Eternalgram a worldwide, royalty-free license to host, display, back up, and (for public memorials) distribute that content for the purpose of operating the service.
5. Prohibited content
You may not upload or post content that is unlawful, hateful, harassing, sexually explicit, gratuitously graphic, fraudulent, or that infringes the rights of others. A more detailed list of prohibited content is available in our Content Policy.
6. Impersonation
You may not create a memorial for a person whom you have no reasonable connection to or authority to memorialize. You may not impersonate another person, family member, or organization. We reserve the right to remove memorials that appear to be created without the knowledge or consent of the deceased's family.
7. Copyright & media responsibility
You represent that you own, or have permission to use, every photograph, video, audio file, and written piece you upload. You are solely responsible for the rights status of media you add to a memorial. If you believe content on Eternalgram infringes your copyright, please file a notice through our Removal Policy.
8. Public memorials
Public memorials are readable by anyone with the URL or QR code and may be indexed by search engines. You acknowledge that once content is published publicly it may be cached, archived, shared, or copied by third parties outside our control. Marking a memorial private prevents new public access but cannot retract copies already made.
9. Availability & no perpetual guarantee
We intend Eternalgram to endure, and we operate the service with that intention. However we cannot, and do not, guarantee perpetual or uninterrupted availability. The service is provided “as is” and “as available.” If we ever discontinue the service we will give reasonable notice and provide export options where possible.
10. Limitation of liability
To the maximum extent permitted by law, Eternalgram and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, profits, or goodwill arising out of your use of the service. Our total liability for any claim arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months preceding the claim or one hundred US dollars (US $100).
11. Suspension & termination
We may suspend or remove accounts, memorials, tributes, or uploaded media that violate these Terms, our Content Policy, or applicable law. Where appropriate we will notify you before action is taken and provide a chance to appeal. You may close your account at any time by contacting us.
12. Dispute resolution
We hope you will contact us at legal@eternalgram.com before pursuing formal action; most issues can be resolved promptly and respectfully. Any disputes arising out of or relating to these Terms will be resolved by binding arbitration in the jurisdiction set out below, except that either party may seek injunctive relief in court for intellectual-property or confidentiality matters.
13. Governing law
These Terms are governed by the laws of the jurisdiction where Eternalgram is incorporated (to be specified upon entity formation), without regard to its conflict-of-laws principles. Until a specific governing jurisdiction is published here, disputes will be governed by the laws applicable to the operator's principal place of business.
14. Changes
We may update these Terms. Material changes will be communicated by email to active account holders and will take effect 30 days after notice. Continued use after the effective date constitutes acceptance.
